Last updated: February 26, 2026

These Terms of Service (hereinafter referred to as the "Terms") govern the procedure for accessing and using the VARIK PRO service (hereinafter referred to as the "Service"). By registering with the Service or using it, you confirm that you have read these Terms, accept them in full and undertake to comply with them. If you do not agree with any provisions of the Terms, you must stop using the Service.

1. Terms and Definitions

For the purposes of these Terms, the following definitions are used. "Operator" — VARIK PRO. "User" — any individual or legal entity using the Service. "Service" — the VARIK PRO software and hardware complex and its access interfaces, including web.varik.pro, Telegram Mini App and Telegram bot varik_pro_bot. "Infrastructure" — computing and network resources that ensure the operation of the Service. "Subscription" — the right of access to the paid functionality of the Service granted to the User under the terms of the Public Offer.

2. General Provisions

The Service is provided on an "as is" and "as available" basis. The Operator makes reasonable efforts to ensure uninterrupted operation of the Service, but does not guarantee the absence of technical failures, errors or interruptions. The Operator reserves the right to modify, suspend or terminate the Service (in whole or in part) with at least 7 days' prior notice to users or without notice in case of emergency circumstances.

3. Nature of the Service and Infrastructure Model

The Service provides limited access to computing and network resources. The Service is not a telecommunications operator within the meaning of Federal Law No. 126-FZ dated July 7, 2003 "On Communications" and does not carry out activities related to the transmission of electronic communications. The Operator does not control the purposes of use of the provided network resources. The provided computing and network resources are a technological tool; the responsibility for the nature and legality of the use of these resources lies solely with the user. The Service is not intended for circumventing access restrictions established by authorized bodies or for committing other illegal activities.

4. Service Access Interfaces

The Service is accessible through several equivalent interfaces, including the web interface (web.varik.pro), Telegram Mini App and Telegram bot varik_pro_bot. All interfaces are equivalent means of accessing a single Service. The use of any of the interfaces implies agreement with these Terms and the Privacy Policy. Functionality, tariffs, limits and usage rules are the same for all interfaces unless explicitly stated otherwise.

5. User Accounts

To use the Service, you need to create an account by providing accurate, complete and up-to-date information. You are responsible for the security of your credentials (login, password) and for all actions performed using your account. If you discover unauthorized access to your account, you must immediately notify the Operator. The Operator is not liable for losses arising from unauthorized use of your account.

6. Authentication via Third-Party Services (OAuth)

The Service supports authentication through the following providers: Google, Discord, Telegram, Yandex, VK (VKontakte). When authorizing through these services, we gain access exclusively to a minimal set of your profile data (name, email address, identifier). We do not obtain extended access rights to your data from these providers. By authorizing through OAuth, you also accept the terms of service and privacy policy of the respective provider. You can disconnect the integration with the provider at any time through the security settings of your account with that provider.

7. Acceptable Use

You agree to use the Service in accordance with the legislation of the Russian Federation and these Terms. The User independently assesses the legal risks associated with the use of the provided network resources in their jurisdiction. It is prohibited to: (a) use the Service for purposes contrary to the law; (b) violate the integrity and operability of the Service; (c) transmit malicious software through the Service; (d) take actions aimed at circumventing the restrictions of the Service; (e) use the Service to distribute prohibited information; (f) provide access to your account to third parties or resell access to the Service's resources.

8. Abuse Protection

The Operator reserves the right without prior notice to: (a) temporarily or permanently block a user's account; (b) restrict access to individual functions or servers; (c) cancel an active subscription — in the event of a violation of these Terms, attempts to exploit vulnerabilities, creating excessive load on the infrastructure or other abuses. The issue of refunds is resolved in accordance with the Public Offer and the legislation of the Russian Federation. The decision to apply protective measures is made at the discretion of the Operator. The User has the right to contact support to clarify the reason for the restriction, if this does not interfere with ensuring the security of the Service.

9. Fair Use

The Service is provided for individual use. The Operator establishes load limits on computing and network resources, which may vary depending on the tariff plan and the current load of the infrastructure. It is prohibited to: (a) use automated means to create multiple connections beyond the established limits; (b) use the Service's resources for cryptocurrency mining, mass mailing, port scanning, attacks on third parties or other actions that create a disproportionate load; (c) systematically exceed reasonable resource consumption limits. The Operator reserves the right to unilaterally adjust limits and usage rules.

10. No Guarantees

The Operator does not provide and expressly disclaims the following guarantees: (a) guarantee of anonymity or the impossibility of identifying the user; (b) guarantee of circumventing any access restrictions established by third parties, government authorities or providers; (c) guarantee of permanent access to any specific internet resources, services or protocols; (d) guarantee of a specific connection speed or latency; (e) guarantee of operability in the territory of specific states. The User independently assesses the legal, technical and other risks associated with the use of the provided resources. The Service provides technical infrastructure without any warranties regarding specific results of its use.

11. Acknowledgement of Internet Usage Risks

The User understands and agrees that the use of the Internet involves risks, including the possibility of restricted access to resources, technical failures, actions of third parties and government restrictions. The Operator does not guarantee the achievement of any specific goals when using the Service. The User independently makes the decision to use the provided computing and network resources and is responsible for assessing the legal consequences of such use in their jurisdiction.

12. Payment and Subscriptions

All intellectual property items placed in the Service (software code, design, graphics, texts, trademarks) are the property of the Operator or are used under license agreements and are protected in accordance with the Civil Code of the Russian Federation (Part Four). Use, copying, modification or distribution of said items without the written consent of the Operator is prohibited.

14. Limitation of Liability

The Operator is not liable for: (a) temporary unavailability of the Service due to maintenance, equipment failures or actions of third parties; (b) losses arising from the use or inability to use the Service; (c) actions of third parties, including OAuth providers, payment systems and telecommunications operators; (d) loss of data for reasons beyond the Operator's control; (e) blocking of access to the Service or its components by third parties, including providers and government authorities; (f) any consequences of the user's use of the provided network resources. The aggregate liability of the Operator on any grounds cannot exceed the amount actually paid by the user for the last 3 months of using the Service.

15. Indemnification

You agree to indemnify the Operator and its affiliates for any losses, expenses (including reasonable legal costs) and third-party claims arising from your violation of these Terms, applicable legislation or the rights of third parties when using the Service, including those related to the nature of your use of the provided computing and network resources.

16. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the legislation of the Russian Federation. All disputes arising in connection with these Terms shall be resolved through negotiations. If agreement cannot be reached, the dispute shall be referred to a court at the location of the Operator in accordance with the current legislation of the Russian Federation.

17. Termination

The Operator has the right to block or delete your account without prior notice in the event of: (a) violation of these Terms; (b) violation of applicable legislation; (c) actions causing damage to the Operator, the Service, the infrastructure or other users; (d) receipt of a motivated request from authorized government bodies. You can delete your account at any time through profile settings or by contacting support. When deleting your account, your personal data will be processed in accordance with the Privacy Policy.

18. Changes to the Terms

The Operator reserves the right to make changes to these Terms. Users will be notified of significant changes by email or by posting a notice in the Service no less than 7 days before the changes take effect. Continued use of the Service after the changes take effect constitutes your agreement to the updated Terms.
